Epos Now Case Study: Commercial Retainer and DPO Service

Epos Now has undergone significant growth since its creation and we are proud to have supported the business with its Commercial Law requirements since 2016.
What do Epos Now do?
Epos Now has become the largest electronic point of sale provider in the UK and has made a significant impact in the US following the opening of its offices in Orlando, Florida. Initially innovating the EPOS market by creating bespoke cloud-based software solutions for retail and hospitality businesses, they continued their market disruption by launching the first app store within the EPOS industry to provide its customers with a range of in-house and third party apps which can be used within its systems.
Epos Now was recognised as the 46th fastest growing company in Europe by the Financial Times in 2017 and has won multiple awards, including being a ‘Tech Innovator’ by the EDP Business Awards in 2016 and the ‘Best SaaS Product for small business/SMBs’ in the 2017 SaaS Awards.
How have we assisted Epos Now?
We were engaged by Epos Now to provide our Commercial Retainer Service in 2016 with the aim of refining their Customer T&Cs, Partner Agreements, Website Policies and undertaking contract negotiations with the business’s ever-growing list of suppliers, customers and business partners.
In the lead-up to the GDPR implementation date we extended the scope of our services to assist with the business’s data protection program and Cracknell Law was appointed as Epos Now’s Data Protection Officer (DPO). This involved: conducting in-depth privacy audits and regular Exec team briefings, firm-wide training sessions, data flow mapping for international data transfers (and implementing suitable data transfer agreements), creating a bespoke suite of internal policies as well as external Privacy Notices and communications to its customer and supplier base.
Following the initial GDPR compliance assistance, we have also been involved with providing oversight and assistance with: the US business’s certification under the Privacy Shield; subject access requests; and data protection impact assessments for service developments.
On the Commercial Law front, we provide our retained legal services to provide responsive advice to manage the growing number of high value agreements and recently conducted the contract negotiations for a multi-million pound deal which will help further secure the business’s future as a leading tech company in Norfolk and beyond.
